In addition to our extensive experience as prosecutors, Libby Hoopes Brooks & Mulvey attorneys previously worked at several of Boston's largest law firms and held clerkships with distinguished federal court judges. From this solid foundation of training and experience, Libby Hoopes Brooks & Mulvey is well equipped to handle a broad array of complex civil and administrative litigation. While we are selective about the types of civil cases we undertake, Libby Hoopes Brooks & Mulvey has represented clients as both plaintiff and defendant.

Libby Hoopes Brooks & Mulvey has enjoyed considerable success in the civil litigation area and has been been active in various contract, commercial, securities, construction, and constitutional cases. While most of the cases currently ongoing are within the state and federal courts of Massachusetts, others are pending in other jurisdictions.

For example, in one high profile "job action" targeting a large local employer, Libby Hoopes Brooks & Mulvey lawyers appeared simultaneously in three separate courts, defending applications for criminal complaints sought against mid-level managers and senior employees. In each case, the court rejected the application and no charges were filed.

Libby Hoopes Brooks & Mulvey has also enjoyed a string of successes representing college and graduate students charged with criminal offenses and related disciplinary violations, facing expulsion or suspension from colleges and graduate schools in the Boston area. To date we have helped to exonerate students at Harvard University, Boston College, Boston University, Northeastern University, and Babson College.

Civil Rights and Whistleblower Action Against Police Officials Dismissed

Libby Hoopes Brooks & Mulvey represented the Chief of Police and two superior officers of a major Boston area police department in a federal civil rights and whistleblower action brought by a fellow officer. After discovery was completed, a judge granted Libby Hoopes Brooks & Mulvey's motion for summary judgment and dismissed the case, which was upheld by the appellate court.

Claim Against Major Pharmaceutical Firm Defended

Working together with outside corporate counsel, Libby Hoopes Brooks & Mulvey represents a major publicly traded pharmaceutical company in a massive "average wholesale price" multi-district litigation action in the federal court.

Libby Hoopes Brooks & Mulvey Persuades U.S. Customs to Overturn "Failure to Declare" Forfeiture

On re-entering the United States, a Libby Hoopes Brooks & Mulvey client — then suffering from certain medical and psychological ailments not immediately apparent to federal officers — failed to fully account to the U.S. Customs Service all of the (significant) monies in the client's possession. Libby Hoopes Brooks & Mulvey interceded with Customs officials on the client's behalf, and arranged to have the forfeiture order reversed, with the monies returned to the client.

Home Builder Obtains Favorable Judgment

Libby Hoopes Brooks & Mulvey represents one of the nation's largest builders of luxury homes in civil litigation and arbitrations in Massachusetts. Recently, we obtained a summary judgment order on behalf of our client in a case alleging various construction defects and fraud. Libby Hoopes Brooks & Mulvey has also had several successful results for the same client in other court cases and arbitration proceedings.

Harvard Students Cleared of Sexual Assault

In unrelated actions (in different school years) commenced by the University disciplinary board, Libby Hoopes Brooks & Mulvey has represented three Harvard students charged with sexual assault. These cases carry profound consequences, including the prospect of a parallel criminal prosecution by local authorities. With Libby Hoopes Brooks & Mulvey's assistance, each of our clients was cleared of wrongdoing and went on to graduate.
